As a retired lawyer, I find everything the Department of Injustice and its client ogres to be extremely distressing. I remain optimistic, however, that the rule of law will prevail. Less so that the R's in Congress will ever do their jobs instead of remaining silent and subservient.
If ICE has reason to believe Judge Dugan had committed a federal offense they could have made a report to the Federal prosecutor in that district, an indictment could have issued, and she could have been given notice in writing to appear at an arraignment. The way this was handled is a disgrace.
While the intimidation is obvious, the innocence or guilt of the judge is not clear. The devil is in the details. She may have done nothing illegal or this may be a case of civil disobedience depending on whether the charges stick. Morally she is on the high ground, legally maybe on a peat bog. Unfortunately, keeping ICE’s tentacles out of state and local courts so they can function relies solely on the ethics and understanding of our democracy by the federal government. Those are obviously in short supply.
Joyce Vance did an analysis of the case at Civil Discourse that is worth reading. I also recommend Lisa Needham's article at Public Notice. The Trump DOJ and FBI want to fight this in the public space rather than in a courtroom where it belongs, and where it will be shown that they do not have a legal leg to stand on.
Intimidation is not the goal, it is the strategy. With the support of the six Christian Nationalists on the Supreme Court the Felon and president Musk are changing the United State in an authoritarian theocracy, with the Felon as the leader and the American oligarchs running the Country.
ALL of the illegal actions in deporting residents (including US citizens) are about distraction to deflect from the Felon's failing economy, failing attempts at cutting fraud and abuse, and the attempted cutting of taxes for the top 20% while destroying the Middle Class and increasing the numbers of poor Americans.
My question about ALL the illegality that Trump 2.0 has engaged in for the past 98 days:
Why are our laws so badly drafted, and our legal system so glacially slow, that he can get away with all of this ???
Why are the OBVIOUS issues, that we are NOT in a state of war or invasion with Venezuela for example, not brought IMMEDIATELY to the courts, and slapped down ?
We seem astonishingly vulnerable to this frontal attack on the Constitution.
Our laws are fine. Had the six Christian Nationalists on the Supreme Court not provided the Felon immunity (there is nowhere in the Constitution providing immunity to the President of the United States - the decision was completely unconstitutional), the Felon would have been tried under the Espionage Act and the attempted coup using fake electors.
Then why can Trump engage in all the illegality he's been throwing at us for the past 98 days without the courts stopping all of it quickly and efficiently ??
Because the six Christian Nationalists on the Supreme Court gave him immunity. This decision was the most egregious and unconstitutional decision made since the Court said Japanese internment camps were legal. No where in the Constitution is the President given immunity for his/her lawlessness.
It's hard to decide which is more absurd, the thuggery of the federal government dragging a state judge unnecessarily and inappropriately through the criminal system, or the juvenile chest-pounding postings and rants of Trump's sycophantic appointees. History will not be kind to this gang of misfits.
For me, I don't need more facts, the circus of Judge Dugan's arrest says it all. I have no patience for treating this like any other arrest - don't judge until you have all the facts. No. That's what the bad actors want - this pause on a full throated condemnation because the norm is to "get all the facts". Sorry, I feel that we are past that point of "normal".
I was horrified to see the AG on a Fox news clip stating the facts of the case and pronouncing the judge guilty. There is no longer a presumption of innocence in this administration
This regime will stoop to any level to harass, intimidate, threaten, or silence anyone who gets in their way or is an obstruction to their lawlessness mischief and sophistry. The court system must continue to prevail but until the congressional majority takes a leadership role to stop their Fascistic governance it will never end and we will be fully steeped in fascism. If they won’t do their jobs then it’s up to we the people.
No one is above the law, except for the Felon (and sexual assaulter) in Chief and his favored cronies.
Also, it seems more than coincidental that the judges targeted seem to be disproportionately women.
I've noticed that also, Susan. Funny thing about that ....
The irony is magnificent: "No one is above the law."

The courts are, by nature, slow and deliberative. El Presidente and his goons move faster than the law can keep up.
