Thank you for that information. I can see that eventuality arising. trump and musk are out of control! I hope that if members of the Supreme Court go against the Constitution, the military can arrest them as well.
They are propelled by an agenda ...and $$ and jail ? They will not back down and if they do...they will snake over to another grass...an exhausting fight for Democracy...brought on us...but we now have no other choice but to DEFEND
I know, Virginia, that is what we all keep wondering...but most of them are sheep...they don't think for themselves and/or they don't care.
Even when circumstances caused by the first felon impact them personally in a negative way, they most likely will not comprehend that trump is truly responsible. .....Just keep in mind all of the thousands of people who refused to wear masks or get immunized during covid; the ones who refused to admit that they had covid even when they were dying from covid!!!. If a a real and true health threat isn't going to "wake" these people up, I doubt that anything will!!!
I think of deeply seated cults as a kind of mental malware, and some historical examples illustrate how delusional they can become. Perhaps we are all somewhat resistant to inconvenient evidence of our own folly, but cults often punish, often viciously, natural curiosity and empirical confirmation. I am confident that Trump and Musk know what they are doing (whether or not they trouble to think about probable outcomes outside of advancing their own agendas) but I suspect that many of the rank and file are trapped in seductive circular thinking.
I know some who were raised in such a milieu who rejected it later. I recall that Elizabeth Warren accepted "GOP" economic talking points until she did her homework.
And some pay more attention (if they are lucky) if reality fires some shots across their bows.
This morning's NYT reports on some cracks. Republican members of Congress who are all for the blasting of the deep state are squealing about cuts to research and USAID crop purchases in their states and are demanding exceptions.
Demanding exceptions would be laughable in a sane world. But, they will probably get some relief. Blue states must immediately stop sending money to Washington which then is redirected to red states. Starve the beast!
This is my worry. Hegseth will do whatever Trump tells him to do - that's the only reason he was given the job - and if the military is ordered to do anything, it will be to support the dictator.
Fascinating perspective on potential outcomes of the current activities of the current regime. I hope that Trump resigns before that happens. fElon and his "Muskivites" should be marched out in cuffs by Seal Team Six.
Thx for the link. Most important points for me: "once a dictatorship is established, history shows that only force can get rid of it" and "we have a lot riding on whether there are any of what we might call Constitutional generals left in the Pentagon when Trump and Hegseth are done with it."
Last night (Feb. 11), I listened to Glen Kirschner on youtube. He discussed these issues and emphasized that the Marshals have always followed the constitution. Kirschner (a long time prosecutor, including in the DoJ) opines that the Marshals have always been proud of their loyalty to the Constitution. He says that they take their jobs seriously and will likely not support an illegal mandate. Take a look at it; it's well worth watching.
He worked with them for many, many years as a prosecutor. And they do have a long record of going with the Constitution. Watch the video. It's not very long.
Exactly what I was going to post. They don't care. And apparently the Rethuglicans in Congress don't either. So who is going to make the rule of law stick?
"If Aristotle, Livy, and Harrington knew what a republic was, the British constitution is much more like a republic than an empire. They define a republic to be a government of laws, and not of men." - John Adams
The court would have to make it a civil matter, which escapes the pardon power, so I guess the courts would have to settle for fines instead of imprisonment. I think the fines are limited in size, but can be imposed daily until the miscreant chooses to behave.
What galls me is that taxpayers are now covering Donnie's legal expenses in all of these lawsuits . . . he doesn't care how many DoJ attorneys are tied up defending his actions. (Perhaps enough of them to throw a wrench into his retribution program?)
I have talked to cancer patients who are in remission due to research trials. I just talked to someone whose husband's cystic fibrosis is under control due to having had access to a trial. I think getting the names of patients whose trials have been cancelled and representing their interests would be a worthy endeavor.
Jeanine, you might or might not know Tristen Snell has a sub stack and collecting stories of people who are harmed by cut, particularly in Medicare. He could be helpful to you and you to him if you would care to share what you were working on about patience since how they are suffering from these cuts. It was this morning unless it was yesterday that he wrote about reaching people through the sharing of stories. The point was that many of the people do not relate to accounts of the legal actions or the reasons for them, but they do react to learning people stories. When they learn the suffering that is going on in the struggles people are facing because of these cuts, and when they realize that the suffering could also affect them or their loved ones, the tragedy of the situation is more likely to register with them. Only them will some people become aware that they need to act to help save our democracy and our programs that are so desperately needed in this country. I believe you can find Tristen Snell online and which Substack if you wish. Since I am unable to see the beginning of this message to edit or proofread it, I am letting you know here that I did try.
Jeanine, I think that is a worthy endeavor indeed! How I hope each person can be saved and have the best results possible for longer, comfortable, enjoyable life! Is there a place to send names or to suggest somebody contact a particular phone number or site yet? I would be glad to pass it on if you find one. Your answer here should reach me.
I should have asked you this earlier, but I had just read about the request for stories regarding health, and that dominated my mind. I apologize for being so slow and tunneled in my thinking today. If you reply and include a number or site for anyone needing to make such a contact, I will be glad to forward the information to a few people in case they know of somebody needing it.
I simply don't understand how Norm Eisen has the time to file lawsuits and at the same time keep us so well informed. Does the man ever sleep? Bless him and all his activist colleagues!
The message has to get through to the voters on the street. There is not exactly a national hew and cry. Democratic leadership needs to step up and be heard. The average American hasn't a clue what's actually going on and 4 years of lawsuits ended in Cheetolini being elected. I'm thrilled these lawsuits are being filed but there needs to be more NOISE!
We need an effective communicator ,charismatic democratic leader to take it to Trump and Musk publicly… call them out , the media will have to cover that, but this person must be willing to risk their life or at least deal with treats from maga.
And main stream media is NOW ON BENDED KNEE...other than honest and factual sites like these most will. not know...and we must tell them and tell the truth...over and over ...our homework
Yes, Lucy Buxton, and everyone, the truth needs to be heard by everyone in order to make a difference. That is why putting people’s real life stories of consequences resulting from these rulings, with the people’s permission of course, in the public eye will help many other people relate to what is happening. I think the human stories rather than legal terms and governmental or court stories will reach the brains and hearts of some people who otherwise have no concept of what the current events and destruction mean.
Sandy, that’s so helpful that you posted the site! Thank you! (While I know posting it is most helpful, changing phone screens to find it in the tiny font, and then getting back to the screen I wanted, made it seem daunting to me.). You see a blessing!
Some people in the Trump administration must now speak up. It is impossible for even some MAGA personnel not to understand the fascist bowel movements occurring in this administration. Public demonstrations must start to occur ASAP.
I appreciate this analysis but it totally ignores the pardon power. My understanding is that at each point in this hypothetical, Trump could pardon any of his actors and everyone would have to stand down. Or is there something that says he can’t pardon contempt of court charges?
Yes, I have also thought that the military would ultimately have to be involved, but Trump is popular with large swathes of the military. Those people might not cooperate.
The only pardon exception this piece cites is disobeying an order to show up at court. Trump can just pardon his thugs before they are even ordered to show up in court. He can pardon them when they are indicted.
I’d love to be shown what I’m missing but I don’t see how Trump’s pardon power doesn’t insulate him and everyone that does his bidding from legal accountability
I wonder that as well, New Texucan. I certainly hope the suits and court decisions will be enforced, and I am grateful for all of the people who are working on it, including Norm! Thank you for sharing your question.
Preet Bharara explained the temporary blocks this am. A judge enters a TRO when the plaintiffs shows there is immediate danger to persons if the defendant's action continues. The judge stops the defendant's action, without hearing from the defendant, until both sides can argue before the judge. In the case of the TRO entered last Friday preventing DOGE from accessing sensitive personal data stored on Treasury Department servers, a judge will hold oral arguments from both sides on the constitutional challenge raised by the plaintiffs [attorneys general in Democratic states] this Friday. One week.
Musk can't be arrested until he's charged with a crime, which requires evidence gathered during an investigation. None of that has happened yet. All of that is what's known as due process/the rule of law. Arresting someone without an arrest warrant signed by a judge is what they do in Russia. You don't want that, yes?
And if the first judge rules against Trump, he will appeal, and keep doing so until he gets to the Supremes. Meanwhile, there is no guarantee they are fully complying with the restraining orders. No one is (or will be) investigated by the Trump DOJ for any criminality, though I suspect they would use the "just following orders" defense. The pattern is clear. The country has been taken over.
In the case of DOGE accessing sensitive personal data stored on Treasury Department servers, there are two judges. The first judge entered the TRO. The judge on Friday will have a hearing and decide whether or not to keep the order. If he or she does, yes, of course Trump will appeal, all the way to the SC. And of course the question is what will happen if he defies the SC. We're not there yet.
As to their compliance, I don't know if they are complying or not. Do you? If so, please provide links to credible news sources.
And if they don't comply in the future, I don't know what the process is. Do you?
I wonder the same thing. Maybe it’s a naive and simplistic question… why can’t Musk and his little tech bros be arrested by the DC police for breaking into the Treasury building, Dep’t of Education building, etc.? Are those buildings not in their jurisdiction?
I know that, but the computers and files are inside buildings. Aside from the Treasury building, where they were given access by Bessent, who gave them access to the other federal buildings they’ve been in? Just curious…
In addition to the legal resistance, the Dems should launch a public campaign, complete with ads on TV. demonstrating what Trump/Musk are trying to do and the consequences.
Thank you for your hard work. I’m in Canada where we are starting to feel the wrath of the upcoming Tariffs. I totally agree that there needs to be a mainstream information campaign to alert those people who are not in the ‘ Contrarian… MSNBC…. Followers’..group….let’s face it …. I live in a small town in Alaska. My good friend was hired for a permanent job with the National
Park Service (a position that already existed and was vacant). She went through the hiring process, did all of her on-boarding, sign a contract, gave notice at her job, did t apply of a different job, gave away another part time job she uses to make ends meet. She would have started on Monday Feb 10, but she was informed she no longer has the job. Now she is out of work. She lives on little so this is a big hit. She was told that if the position came back it would be re-announced and she would have to apply again. This is cruel and it is not the only story like this in our area. It’s happening to others. Federal employees make up a large portion of Alaska’s work force and many people rely on National Park Service seasonal jobs to make ends meet and they are not filling any of them.
All of this downsizing of the civil service will soon show up in unemployment figures. Maybe then people will wake up to the fact that Trump and doge are destroying not only our government , the rule of law but the whole fabric of our society.
I’m gratified by all the lawsuits, but concerned about how the rulings will be enforced. Both Trump and Musk have no respect for the law.
I echo your concern!
This might help with your concerns. https://open.substack.com/pub/luciantruscott/p/how-the-looming-trump-constitutional?utm_source=share&utm_medium=android&r=6ptqj

Kirschner has been wrong about everything for years now
They work for Pam Bondi.
And, Pam Blondie will do exactly what she is told. We already know we are dealing with one of the most corrupt authoritarian regimes in the world.
No they don't.
Yes, they do. The United States Marshals Service is a bureau within the Department of Justice.
Sounds good. Does he provide any evidence that the Marshals have always followed the constitution? Or does he just make the statement?
You just need enough Marshals to form a posse.....
That wasn't my question.
He worked with them for many, many years as a prosecutor. And they do have a long record of going with the Constitution. Watch the video. It's not very long.
OK, he's citing is own lengthy experience. That's good enough for me.
Thank you for sharing this dite, Gail Adams Fla/Va. I look forward to reading it when my eyes are rested enough to let me.
I honestly don't see how anyone could find that article comforting. To me it is worst case scenario.
Thank you! Very interesting almost encouraging!🙏🇺🇸🙏🇺🇸🙏🇺🇸
Very helpful. Thanks...
Excellent write up and thank you...it helps my "constitution" in these fearful times....
Exactly what I was going to post. They don't care. And apparently the Rethuglicans in Congress don't either. So who is going to make the rule of law stick?
The lawsuits are worth filing. Use the tools we have
"If Aristotle, Livy, and Harrington knew what a republic was, the British constitution is much more like a republic than an empire. They define a republic to be a government of laws, and not of men." - John Adams
Donnie Dbag has been given permission by SCOTUS to commit all the crimes he wants; mere contempt of court is beneath his notice at this point.
But if a court orders a department head to do something, and it doesn't get done, THAT person can (and should) be hauled off and thrown into a cell.
Couldn't trump then just pardon that person?
The court would have to make it a civil matter, which escapes the pardon power, so I guess the courts would have to settle for fines instead of imprisonment. I think the fines are limited in size, but can be imposed daily until the miscreant chooses to behave.
What galls me is that taxpayers are now covering Donnie's legal expenses in all of these lawsuits . . . he doesn't care how many DoJ attorneys are tied up defending his actions. (Perhaps enough of them to throw a wrench into his retribution program?)
I think those fines are extremely limited in size, plus trump can just get Elon, who has made hundred of billions since the election, to pay them all.
Agreed. It feels like fiddling while Rome burns
Mark Elias of Democracy Docket wrote that judges have the power to contract privately with prosecutors and possibly also marshalls, if need be.
What would they be contracting? Confused.
True and they said they would not obey judges rulings.
Bingo
Same here. I salute the effort, but think we've already lost the country.
Thanks, Gail.

Yes...the FOX listeners really believe Musk is doing a good job!
What is the likelihood that any of these legal judgements can actually be enforced? Who would do the enforcing?
And is there any way to bring some of these legal actions into State courts, where Trump’s pardon powers can’t reach?
I'll repeat it, Bradley, since there doesn't seem to be much response. Bring up charges on the state level. Whatever it takes.
Some people in the Trump administration must now speak up. It is impossible for even some MAGA personnel not to understand the fascist bowel movements occurring in this administration. Public demonstrations must start to occur ASAP.

Why can’t Trump pardon a federal contempt charge?
Thx for the link.
That IS the question.
They will comply with an Order from their General..that is the safeguard still with us
Their Commander in Chief is Trump. At best we can assume their allegiances are split. As with everything Trump has done, it divides and destroys.
The US Marshalls. But they're in the DOJ.
I wonder that as well, New Texucan. I certainly hope the suits and court decisions will be enforced, and I am grateful for all of the people who are working on it, including Norm! Thank you for sharing your question.
Why only temporary blocks?
Why hasn't Musk been arrested?
Charges must be brought for an arrest warrant to be initiated. Legal minds must think carefully before such action is taken. The sooner the better.
Preet Bharara explained the temporary blocks this am. A judge enters a TRO when the plaintiffs shows there is immediate danger to persons if the defendant's action continues. They haven't broken in. They were given access.
Yes, Secretary of the Treasury Scott Bessent gave them access to the Treasury building. What about the Dep’t of Education and other federal buildings?
Reports of the kiddies "breaking in" mostly refers to breaking into computer and file access.
I know that, but the computers and files are inside buildings. Aside from the Treasury building, where they were given access by Bessent, who gave them access to the other federal buildings they’ve been in? Just curious…
Please also begin to include whether the judicial orders have been followed or ignored.
We don't really even know what the Muskovites are doing, so how can we judge?
From Louisville KY — Thank you, thank you for all your hard work!
Same thanks from Illinois. Keep it coming!
In addition to the legal resistance, the Dems should launch a public campaign, complete with ads on TV. demonstrating what Trump/Musk are trying to do and the consequences.

Screw the TV ads. Take to the streets!
Are there any class action lawsuits against Musk and Trump for violating our privacy? I did not permit to have anyone have my personal information
Yes, there are class action suits, including unions and other entities like that. (Sorry, I can't remember the lists right now).
Thank you, Jen and Norm for following through on the reality info, legal challenges, and inspiring us to wotk together to support you and all good democratically oriented govt. officials to save our country. DrFreddy😍🎼

Yes, it's not working. I can't get to the video of the discussion between Jen and Norm.
I really appreciate short to-the-point written articles and prefer them to audio. This one is perfect. Thanks for all you do.
Me too. I can read faster than I can listen. And I can scan text to get the main idea. Can't do that with audio or video.
Same here!
I agree!

didn't Alaska go for trump.....
Like everyplace else, a large minority of voters did not go from Trump.
